Please read these Terms of Service ("Terms") carefully before using the Lunker AI mobile application ("App," "Service," or "Lunker AI"). By downloading, installing, or using Lunker AI, you agree to be bound by these Terms. If you do not agree, do not use the App.
By accessing or using Lunker AI, you confirm that you are at least 13 years of age, you have read and understood these Terms, and you agree to be legally bound by them. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The AI analysis features are provided for informational and recreational purposes only. Lunker AI does not guarantee the accuracy of any AI-generated recommendation or analysis.
3.1 Registration
You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep your account credentials secure and confidential.
3.2 Account Responsibility
You are solely responsible for all activity that occurs under your account. Notify us immediately at support@lunkerai.com if you suspect any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
4.1 Your Content
You retain ownership of all photos, catch data, and other content you submit to Lunker AI ("User Content"). By submitting User Content, you grant Lunker AI a non-exclusive, royalty-free, worldwide license to use, store, process, display, and analyze your User Content solely for the purposes of providing and improving the Service.

Aggregated and anonymized catch data may be used to train and improve our AI models. We will not identify you personally in any such use. You may opt out of AI training data use in your account settings.
Lunker AI may collect precise GPS location data when you log a catch, subject to your device permissions. This location data is used to tag your catch entries, generate location-based spot recommendations, and improve regional pattern analysis. You can disable location access at any time through your device settings.
The fishing pattern analysis and spot recommendations provided by Lunker AI are generated by artificial intelligence and are subject to the following limitations:

8.1 Our IP
All software, design, text, graphics, logos, and AI models comprising the Lunker AI App are owned by or licensed to Lunker AI and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
8.2 Feedback
Any feedback, suggestions, or ideas you provide to us may be used by Lunker AI without any obligation to compensate you.
Your use of Lunker AI is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUNKER AI DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNKER AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Lunker AI and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your User Content, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after any modification constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of [YOUR STATE], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App ceases immediately. Sections 4, 8, 11, 12, 13, and 15 of these Terms survive termination.
These Terms constitute the entire agreement between you and Lunker AI regarding the App. If any provision is found unenforceable, the remaining provisions remain in full force.
